Terms and right of withdrawal
Last updated: 30 August 2026
This page is a translation for our English-speaking guests. The German version is the legally binding one.
§ 1 Provider, scope
(1) These terms apply to all orders placed through this website for collection. The provider and contracting party is:
Kanpai GmbHAlexanderstraße 17, 52062 Aachen
Germany
Represented by its managing director: Mezbah Uddin Shaber
Amtsgericht Aachen, HRB 28365
VAT ID DE451862712
Telephone: +49 (0) 241 91793702
Email: info@kanpaisushi.de
(2) Sales are for collection in person only. We do not deliver.
(3) Terms of the customer that differ from these do not form part of the contract, even if they are not expressly objected to.
§ 2 Formation of the contract
(1) The presentation of dishes and drinks on this website is not a binding offer but an invitation to place an order.
(2) By submitting the order, you make a binding offer.
(3) The contract is formed as soon as we confirm the order by email. That email is also our acceptance of your offer.
(4) If an ordered dish is no longer available, or the chosen collection time cannot be met, we will telephone you without delay on the number you gave. The order may then be cancelled in whole or in part; you incur no cost for this.
(5) The contract text is stored and provided to you with the confirmation email. These terms can be consulted on this page at any time.
§ 3 Prices and VAT
(1) All prices shown are total prices in euro and include statutory VAT.
(2) For collection, food is subject to the reduced rate of 7 % and drinks to the standard rate of 19 %. The split is shown on the order confirmation.
(3) No additional delivery, service or packaging charges apply.
(4) The prices displayed on this website at the time of ordering are the ones that apply.
§ 4 Payment
(1) Payment is currently made in cash on collection only.
(2) The purchase price falls due when the goods are handed over.
§ 5 Collection
(1) When ordering, you select a collection time. Food is prepared fresh, so the time is a guide and may shift by a few minutes.
(2) The earliest collection time that can be selected is 30 minutes after the order is received. Only times within our opening hours can be selected.
(3) We hold the order from the selected collection time for 30 minutes. After that we are entitled to dispose of the goods otherwise; the claim to the purchase price remains unaffected.
(4) Please show the order number from the confirmation email when collecting.
§ 6 Alcoholic drinks, protection of minors
(1) We supply alcoholic drinks only in accordance with the German Protection of Young Persons Act: beer, wine, sparkling wine and wine-like drinks only to persons aged 16 and over, all other alcoholic drinks only to persons aged 18 and over (§ 9 JuSchG). German law sets two thresholds rather than one; it applies here because the handover takes place in Aachen.
(2) By ordering alcoholic drinks you confirm that you have reached the applicable minimum age.
(3) We verify age at handover against official photo identification. If age cannot be established, we will not hand over the drinks concerned and will not charge for them. The rest of the order is unaffected.
§ 7 Allergens and additives
(1) Allergen and additive information is given for every dish on the menu of this website.
(2) Fish, crustaceans, molluscs, sesame, soy, gluten, egg and peanuts are handled in our kitchen. Despite careful work, cross-contamination cannot be ruled out. If you have a serious allergy or intolerance, please call us before ordering.
(3) Part of the range contains raw fish. Those dishes are not suitable for pregnant women, young children, the elderly or people with weakened immune systems.
§ 8 Defects
Statutory liability for defects applies. Please raise complaints about the goods immediately on handover where possible, so that we can put them right at once. This does not restrict your statutory rights.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
(2) In cases of ordinary negligence we are liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may rely. In such cases liability is limited to the foreseeable damage typical of this type of contract.
(3) Liability is otherwise excluded.
§ 10 Consumer dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body (§ 36 VSBG).
§ 11 Final provisions
(1) German law applies. For consumers habitually resident abroad, the mandatory consumer protection provisions of their state of residence remain unaffected.
(2) Should any provision be invalid, the validity of the remaining provisions is unaffected.
Right of withdrawal
There is no right of withdrawal for orders of food and drink for collection. The legislator expressly excludes such contracts from the right of withdrawal:
- § 312g(2) no. 2 BGB — goods liable to deteriorate rapidly or whose use-by date would quickly be exceeded. Freshly prepared sushi falls under this.
- § 312g(2) no. 9 BGB — contracts for the supply of food and drink where the contract provides for a specific date or period of performance. The collection time selected when ordering is such a time.
In practice this means: a confirmed order cannot be withdrawn.
This does not affect your statutory rights in respect of defects (§ 8), or the possibility of cancelling an order as a gesture of goodwill while we have not yet begun preparation. Please call +49 (0) 241 91793702 promptly. There is no entitlement to this.
